Terms and Conditions

Effective Date: July 22, 2025Welcome to Fitsy! These Terms and Conditions (“Terms”) govern your access to and use of the Fitsy mobile application, website, and related services (collectively, the “Platform”). By using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.1. Acceptance of Terms:
By accessing or using Fitsy, you agree to be legally bound by these Terms. If you’re using the Platform on behalf of an organization or another person, you represent that you have the authority to accept these Terms on their behalf.
2. User Responsibilities:
a. Eligibility: You must be at least 18 years old to use the Platform. By registering, you confirm you meet this requirement.
b. Account Security: You’re responsible for keeping your account credentials secure and for all activity under your account.
c. Proper Use: Use Fitsy only for lawful purposes. Do not interfere with the Platform, misuse features, or infringe upon others' rights.
3. Personalized Guidance & Content:
a. Informational Only: Any workout suggestions, activity plans, or health-related insights provided through the Platform are for general informational purposes only. They are not intended as medical advice, diagnosis, or treatment, and should not be considered a substitute for professional healthcare guidance.
b. No Expert Claim: Fitsy does not claim to be a certified fitness or medical authority. All guidance is generated based on user inputs and general fitness principles, and may not be suitable for every individual.
c. User Responsibility: You acknowledge and agree that you are solely responsible for your health decisions and actions taken based on recommendations from the Platform. You should consult a qualified professional before beginning any new exercise or wellness program.
d. Assumption of Risk: By using the Platform, you understand and accept the inherent risks of physical activity, and you agree that Fitsy is not liable for any injury, harm, or adverse outcome that may result from your participation in suggested activities.
4. Trainers & Marketplace (Upcoming Features):
a. Trainer Listings: Fitsy may offer a way to connect with personal trainers. These trainers are independent and not employed or controlled by Fitsy.
b. User Due Diligence: You are responsible for evaluating trainer qualifications and making informed decisions.
c. Third-Party Interactions: Fitsy is not liable for any issues arising from sessions, communications, or transactions between users and trainers.
5. Platform Use & Content:
a. License: Fitsy grants you a limited, non-exclusive, revocable license to use the Platform for personal, non-commercial purposes.
b. Restrictions: You may not reverse-engineer, copy, sell, or misuse any part of the Platform.
c. User-Generated Content: By submitting content (e.g., progress logs, comments), you grant Fitsy a global, royalty-free license to use and display it to support and improve the Platform.
6. Intellectual Property:
a. Ownership: All content, branding, and features on Fitsy belong to us or our licensors.
b. Feedback: If you share ideas or suggestions, you allow us to use them to improve the Platform without obligation or compensation.
7. Limitation of Liability:
a. No Indirect Damages: Fitsy is not liable for indirect, incidental, or consequential damages arising from your use of the Platform.
b. Third-Party Interactions: We are not responsible for any injury, loss, or dispute resulting from your use of third-party services (e.g., trainers).
8. Indemnification:
You agree to hold harmless and indemnify Fitsy and its affiliates from any claims, damages, or legal actions arising from your misuse of the Platform or violation of these Terms.
9. Updates to These Terms:
We may update these Terms from time to time. Continued use of the Platform after changes means you accept the revised Terms. Please review them regularly.
10. Governing Law:
These Terms are governed by the laws of the jurisdiction in which Fitsy operates (Ontario, Canada, unless otherwise specified). Any legal action will be brought exclusively in the courts of that jurisdiction.
