Welcome to Fitsy. These Terms and Conditions (“Terms”) govern your access to and use of the Fitsy mobile application, website, wearable integrations, and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
1. Acceptance of Terms1.1 By accessing or using Fitsy, you agree to be legally bound by these Terms and our Privacy Policy.
1.2 If you use the Platform on behalf of an organization or another person, you represent that you have authority to accept these Terms on their behalf.
1.3 These Terms apply to all users, including free users and paid subscription users.
2. Eligibility and User Responsibilities
2.1 Eligibility
You must be at least 18 years old to use the Platform. By creating an account, you confirm that you meet this requirement.
2.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
2.3 Accurate Information
You agree to provide accurate and current information and keep your profile updated.
2.4 Lawful Use
You agree to use the Platform only for lawful purposes and not to interfere with or disrupt the Platform.
AI-Powered Features and 3. Personalization
3.1 Automated Systems
Fitsy uses artificial intelligence and automated systems to generate workout recommendations, insights, fitness scores, and coaching feedback.
3.2 Informational Outputs
All AI-generated outputs are informational only and may not be accurate, complete, or suitable for your individual circumstances.
3.3 No Guarantee of Results
Fitsy does not guarantee fitness outcomes, performance improvements, or health results.
3.4 User Responsibility
You are solely responsible for decisions made based on AI-generated recommendations.
Health and Fitness Disclaimer
4.1 Informational Purpose Only
The Platform provides fitness and wellness information for general informational purposes only.
4.2 No Medical Advice
The Platform does not provide medical advice, diagnosis, or treatment and is not a substitute for professional healthcare guidance.
4.3 Consult Professionals
You should consult qualified medical or fitness professionals before beginning any exercise program.
4.4 Assumption of Risk
You understand that physical activity involves inherent risks and voluntarily assume all risks associated with using the Platform.
4.5 Release of Liability
To the maximum extent permitted by law, Fitsy is not liable for injuries, health issues, or damages resulting from use of the Platform.
5. Apple Health and Device Integrations
5.1 Optional Integrations
The Platform may integrate with Apple Health, Apple Watch, and other wearable services with your permission.
5.2 User Control
You control what data is shared and may revoke permissions at any time through device settings.
5.3 Data Accuracy
Fitsy does not guarantee the accuracy of data obtained from third-party devices or services.
6. License to Use the Platform6.1 Limited License
Fitsy grants you a limited, non-exclusive, non-transferable, revocable license to use the Platform for personal, non-commercial use.
6.2 Restrictions
You may not copy, distribute, modify, reverse engineer, sell, or exploit any part of the Platform without permission.
6.3 Suspension
We may suspend or terminate access if you violate these Terms.
7. User Content7.1 User Submissions
You may submit workout logs, activity data, and other content.
7.2 License to Fitsy
You grant Fitsy a worldwide, royalty-free license to use, store, process, and display submitted content to operate and improve the Platform.
7.3 Responsibility for Content
You are responsible for content you submit and must not submit unlawful or harmful material.
8. Intellectual Property
8.1 Ownership
All Platform content, software, design, trademarks, and features are owned by Fitsy or its licensors.
8.2 Feedback
Any suggestions or feedback you provide may be used by Fitsy without obligation or compensation.
9. Subscriptions and Payments
9.1 Auto-Renewing Subscriptions
Fitsy may offer auto-renewable subscriptions. Subscriptions automatically renew unless cancelled before the end of the billing period.
9.2 Billing
Payment will be charged to your Apple ID account at confirmation of purchase.
9.3 Cancellation
You may manage or cancel subscriptions through your Apple account settings.
9.4 Free Trials
If a free trial is offered, any unused portion may be forfeited when a subscription is purchased.
9.5 Price Changes
Subscription prices may change with notice where required by law.
9.6 Refunds
All purchases are subject to Apple’s payment policies and refund procedures.
10. Third-Party Services
10.1 External Services
The Platform may rely on third-party services including payment providers, analytics tools, and device integrations.
10.2 Third-Party Responsibility
Fitsy is not responsible for third-party services, data accuracy, or availability.
11. Platform Availability
11.1 No Guarantee of Availability
We do not guarantee uninterrupted access to the Platform.
11.2 Modifications
We may modify, suspend, or discontinue features at any time without liability.
12. Limitation of Liability
12.1 No Indirect Damages
To the maximum extent permitted by law, Fitsy is not liable for indirect, incidental, consequential, or special damages.
12.2 Maximum Liability
Fitsy’s total liability will not exceed the amount you paid for the Platform in the preceding twelve months.
13. Indemnification
13.1 User Responsibility
You agree to defend and indemnify Fitsy and its affiliates from claims arising from your misuse of the Platform or violation of these Terms.

Your use of the Platform is also governed by the Fitsy Privacy Policy.
15. Termination
15.1 Termination by You
You may stop using the Platform at any time.
15.2 Termination by Fitsy
We may suspend or terminate access if you violate these Terms.
16. Changes to These Terms

We may update these Terms periodically.
16.2 Continued Use
Continued use of the Platform after updates constitutes acceptance of revised Terms.
17. Governing Law and Dispute Resolution
17.1 Governing Law
These Terms are governed by the laws of Ontario, Canada.
17.2 Jurisdiction
Any disputes will be resolved exclusively in the courts of Ontario, Canada.
