These Terms and Conditions ("Terms") govern your use of the Fitsy platform, encompassing the Fitsy mobile application, website, and related services (collectively referred to as the "Platform"). By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree with any part of these Terms, please refrain from using the Platform.2. User Responsibilities:
a. Eligibility: To use the Platform, you must be at least 18 years old. By accessing the Platform, you represent and warrant that you meet these eligibility requirements.
b. Account Information: You are responsible for maintaining the confidentiality of your account information and all activities under your account. Providing inaccurate information may result in the suspension or termination of your account by Fitsy.
c. Acceptable Use: The Platform must be used solely for lawful purposes and in compliance with these Terms. Engaging in activities that harm, interfere with, or disrupt the Platform's operation or infringe upon other users' rights is strictly prohibited.3. Personal Trainers:
a. Fitsy's Role: Fitsy connects users with personal trainers but does not directly employ or control these trainers. Fitsy is not responsible for the actions, conduct, or qualifications of any personal trainer on the Platform.
b. User Responsibility: Users are responsible for evaluating and selecting a personal trainer based on their needs and preferences, conducting thorough research on qualifications, certifications, and credentials.
c. No Guarantee: Fitsy does not guarantee the availability, accuracy, or suitability of any personal trainer on the Platform. Users are responsible for direct communication and arrangements with personal trainers for sessions, scheduling, fees, and related matters.4. Use of the Platform:
a. License: Fitsy grants a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use of the Platform, subject to these Terms.
b. Restrictions: Users may not modify, adapt, reverse engineer, or use any automated means to access the Platform in violation of applicable laws, regulations, or the rights of others.
c. Content: Fitsy provides informational content but does not assume liability for its accuracy. Users should consult qualified professionals before relying on any information on the Platform.
d. User-Generated Content: By submitting content, users grant Fitsy rights to use, reproduce, modify, adapt, publish, translate, distribute, and display such content.5. Intellectual Property:
a. Ownership: All intellectual property rights in the Platform belong to Fitsy or its licensors. No right or license to use Fitsy's intellectual property is granted without written permission.
b. Feedback: Users granting feedback provide Fitsy with rights to use, reproduce, modify, adapt, publish, translate, distribute, and display the feedback for Platform improvement without obligation or compensation.6. Limitation of Liability:
a. Indirect Damages: Fitsy, its affiliates, and related parties shall not be liable for indirect, incidental, special, consequential, or exemplary damages arising from the use of the Platform.
b. Trainer Interactions: Fitsy assumes no liability for injuries, damages, or losses resulting from interactions with personal trainers. Disputes with trainers are solely between users and trainers.7. Indemnification:
Users agree to indemnify, defend, and hold harmless Fitsy and its affiliates from any claims, losses, liabilities, damages, costs, and expenses arising from their use of the Platform or violation of these Terms.8. Modification of Terms:
Fitsy reserves the right to modify these Terms at any time without prior notice. Users are responsible for reviewing these Terms periodically, and continued use of the Platform after modifications constitutes consent to the updated Terms.9. Governing Law and Jurisdiction:
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Fitsy operates.
